What is the difference between a DA and CDC approval?
A Development Application (DA) is a formal submission to your local council requesting approval for a specific development. Council assesses the proposal against planning controls, and the process can involve public notification and a formal determination period. It offers more flexibility, particularly for sites or designs that don't strictly comply with all planning standards.
A Complying Development Certificate (CDC) is a faster, streamlined pathway that bypasses full council assessment. It's assessed by a private certifier or council acting as certifier and can often be approved in weeks rather than months. The trade-off is that a CDC is only available when a development strictly meets every predetermined planning standard — there's no flexibility or discretion involved.
How long does DA approval take in NSW?
Timeframes vary depending on the council, the complexity of the application and whether additional information or specialist reports are required. As a general guide, straightforward residential DAs can take anywhere from two to six months from lodgement to determination. More complex proposals, or those that attract neighbour objections, can take considerably longer.
One of the most effective ways to reduce DA timeframes is ensuring the application is well-prepared from the outset — complete documentation, all required reports and a design that has been carefully considered against the applicable planning controls. Poorly prepared applications are far more likely to attract requests for additional information, which adds time and cost.
When can you use complying development instead of a DA?
Complying development is available when a proposed development meets all relevant standards set out in the State Environmental Planning Policy (Exempt and Complying Development Codes) 2008. These standards cover lot size, setbacks, building height, site coverage, parking and landscaping, among other things.
It cannot be used on land subject to certain constraints — such as heritage conservation areas, bushfire-affected land, or land where the applicable planning instrument specifically excludes complying development. Even a minor non-compliance with any single standard means the CDC pathway is unavailable and a DA will be required instead.
